Hi everyone,
I need assistance understanding the information I received from Home Office in response to my Subject Access Request (SAR). I was previously in the UK as a Non-EU Tier 4 student. I left the UK in 2015 and now I have Portuguese nationality
The SAR response includes two pages (among several other):
1. Administrative Removal – Leave to Remain by Deception (TOEIC): This page shows “Ban Triggered –
NO
2. Administrative Removal – Overstayer: This page shows “Ban Triggered – YES”. it was triggered in 2017 as per
I have taken the screenshot of the above pages, however not sure, how to add them in the post here
According to the SAR response I received, a ban was triggered due to overstaying, but it does not specify the duration. I’m trying to understand if it is a 10-year re-entry ban and whether anything can be done to remove or challenge it, considering I left the UK nearly 10 years ago.
I left the UK in 2015, but I did not inform the Home Office at the time of my departure. I travelled by ferry and unfortunately do not have any documentation—such as a ticket or travel record—to prove when or how I left.
Now I hold Portuguese citizenship, given this, do I still need to be concerned about the previous immigration ban, or does my current EU status override it?
Any guidance or clarification regarding how to challenge or remove the ban would be greatly appreciated.
