I have a question regarding the naturalisation application (online), specifically the good character part.
I had applied for naturalisation in October 2024 on the basis of CSEP Stamp 1 and Stamp 4.
In the past I had a stamp 4 EU FAM which was revoked and the EU treaty section had alleged marriage of convenience. After the appeal was also rejected I had received section 3 notice. I had disputed the allegations but did not go for a judicial review (solicitor advised against it). Instead I applied to remain on section 3 and was granted permission (stamp 1) for 6 months to apply for CSEP.
I am wondering if I should have ticker “yes” to any of the following questions and provided an explanation?
1. Have you ever committed any offences against the laws of Ireland or any overseas country?
2. Have you ever defrauded any person, company or State agency for financial or other gain?
3. Have you ever engaged in any other activities that might indicate that you may not be considered a person of good character?
I ticked “No” because I had disputed the allegations and ticking “Yes” would have meant I was reversing on my stance. I did upload my section 3 decision letter and a post CSEP letter (I informed repatriation division about getting CSEP and they told me to go directly to burgh quey offices for all future renewals) along with IRP cards. I also did not claim any Stamp 4 EU FAM years and counted my reckonable residence starting from the Stamp 1 based on section 3 outcome.
Can anyone advise if that was the correct approach or not? If not should I upload an explanatory letter or any other documents addressing this?
I have no other offences, traffic violations, points, fines or anything else on my record. In my section 3 application I had addressed the above issue under consideration of good character confirming my stance. I had also sent letters regarding good character and integration (15 personal letters, winning my company's values awards, ethics & anti fraud & bribe courses, charity work and community work acknowledgements).
