EU Treaty Rights in Ireland – Parent of Adult EU Citizens (Not Dependent, One Expecting Baby)

Hi all,

I’m posting for a friend. She is currently waiting on the outcome of an appeal after her General Employment Permit renewal was refused. She has three adult children (aged 20–25) who live in Ireland and hold Italian passports.

She has never been financially dependent on them. Another option mentioned to her was applying under EU Treaty Rights as the parent of EU citizens, but it seems this usually requires dependency. One of her daughters is pregnant, and she wonders if the fact that she will be helping to care for the baby could strengthen an application.

Her question is: given that she is not dependent on her adult children, is there any realistic pathway to apply for residency under the EU Treaty Rights route in Ireland?

Hi,

Her best option is to apply via EU treaty rights. Even if she wasn't dependent on her adult children before she can still apply as dependent now if any of her children are in employment and willing to provide financial means and cover letter.
She can also add babysitting as an excuse but only that won't be sufficient since they might request for financial means from the pregnant mother (Not the husband).
