Work Status When Visa Application in Appeal status

Post by Sazz1 » Tue Jan 20, 2026 8:00 am

Hello,

Hope you are doing well.

I am looking for guidance in a scenario if my visa and my family request has been rejected and we have raised an appeal. During this period can I and my wife can work and earn?

I am on Global Mobility visa and wife is on dependant.

Thanks

"Appeals" for immigration applications generally stopped in 2014.

You will more likely be filing either an Administrative Review (with the Home Office itself) or a Judicial Review (in a tribunal).

If you have filed an Administrative Review within the allocated time, you are covered by Section 3C leave and the terms of your previous visa are extended until either the review concludes or you withdraw the application.

If you file a Judicial Review, you are not covered by Section 3C leave and would not have the right to work in the UK.

Obviously if you are going down this route, I presume you are going through a solicitor. It would be best to consult the solicitor on these points.
