Sorry for the long message, but I believe it is worth it, can all please go through it and give your suggestions/views
In light of maneeshg Message, I will suggest that we should flowing approach
We should fight our case on two fronts, Moral and legal. When I talk about moral I mean we should try our best to pressurise BA UK to treat us on the same grounds as they are going to treat HSMP holder due to new judgement. Whereas, from legal front I mean we should explore how we can legally fight this case, I personally believe that the effort of lost cases in the past should have minimum effort as this time we will take legal ground in lights of new judgement of HSMP holder.
I believe that we should start focusing on both these front parallel. The first think we should do it to select/volunteer the 2 committees (4 to 5) people how are going to take lead on these two fronts. In the following I will suggest some of the steps in this regard
Fighting the case on moral grounds
1. We already have e-petition with 200+ signatures, so hopefully we will get response from govt soon.
2. We should submit a new e-petition as soon as possible which should focus on following two main points.
• That on the WP application forms back there was a clause saying after 4 years we can apply for ILR (this is commitment from BA UK)
• During the case of HSMP, the BA UK arguments were based upon that HSMP and Work permit holder are treated on equal grounds (so now we should be treated in same manner)
X can you please submit a new e-petition and everybody from us should try to reach the target of 200 signatures as soon as possible.
3. We should contact some lawyer to write a letter to BA UK taking into consideration of our e-petition and other arguments. It will be nice if we able to do this via same lawyer who fight for HSMP peoples
4. Write local MP and try to take into media
Fighting the case on legal grounds
I understand that legal battle with govt is an expensive issue in terms of money, time and commitment. However, it is a stage-wise process and we should see think in stages as well.
1. The first stage will be to arrange a meeting with lawyer to get answers to some of the basic points
• What are our chances in light of this new development?
• What is the right time to legally initiate the case, is there any time limit?
• Rough idea about how much time it might in total?
• Rough idea about the expense?
2. I am not an expert about legal fees, however, I think we should be able to have answer of above mentioned question plus draft letter from 700 to 1500 pounds of budget. maneeshg can is it possible for you contact HSMP lawyer to enquire how much they will charge for first meeting?
3. Now the question about finance
4. I think for intial query if 50 out 200 people signed the e-petition donate 20 pounds, we hit the 1000 pounds mark. I think it is easily achievable.
Once we have answer to above mentioned question, then we can formulate the line of action. I think a monthly donation of relatively small X amount with 200 to 500 members should be good enough to fight the case. But we will cross the bridge when we will reach there.
Marvin can you please setup user registration module on the website, so we can become member of WPforum and see to arrange a online donation facility. This forum/website should be our platform in future.
It will be great if some of the people can volunteer for the committee to take lead on moral and legal aspects
