Work Permit+HSMP to ILR

Post by uckocak » Tue Apr 21, 2009 10:02 pm

Hi,

As far as I know, spending 5 years total in UK (Tier 1, Tier 2 or combination) is enough to be eligible for ILR. And the counter for 5 years is reset if you stay outside UK more than 3 months.
Is this rule still valid? And can anyone please give me an official Home Office website link which clearly states this counter resetting rule?
Because a friend said that after new rules, the counter resets even you change from Tier 2 to Tier 1 vice versa.

Thanks, Utkan

Tier2 to Tier1 --------------> counter not reset

Tier1 to tier2 --------------> counter gets reset
(not seen any actual link which says this , but my lawyer mentioned it , dont know how much it is true) ie if ur lower ur immigration status it gets reset ....

please go to the UKBA website and review rules for ILR
its in criteria
that you cannot be out of country for more then 6 months in five year and no single period should be more then 90 days
and Switching b/w either wp to hsmp or otherwise wont effect counter
