Hello all,
I have a question regarding my stepson's impending visa application to come and live in th UK.
I'm British and have been married to my Brazilian wife for nearly 2 years. My wife has the correct settlement visa so all is good on that front.
The next step is to bring her six year old son to come and live with us in the UK. He is currently living with his grandparents from my wife's ex-husbands side.

When we applied for my wife's visa we declared that she had a son although he was not a dependent because he was living with his grandparents. My wife's visa shows her as having zero dependent children, as expected.

We are currently going through the courts to get custody of the child. If we win the court case and we apply for his visa what should I do about my wife's visa? Do I need to get it modified to include the dependent child? Is that even possible? Or do I not need to worry about my wife's visa?

One problem I envisage is when they turn up at Heathrow airport and my wife's visa has zero dependent children in it yet she will have her son with her.
Any thoughts would be greatly appreciated.

Assuming you win the custody battle ... because if you don't it will be a total waste of money proceeding further on the visa front ... an application will need to be made in Brazil for a Child Settlement visa.

Assuming that is granted, and then the child is brought to the UK, I don't think the entry on the wife's visa is an issue.

Don't attempt to bring the child to the UK unless a Child Settlement visa is already in his passport. The application for that visa can only be made in Brazil.

Your assumptions are correct and I completely forgot to state that we would be applying for a seperate child settlement visa.
My main concern is my wife's visa showing zero dependent children.
I'm assuming that because the child will have his own visa, my wife's visa not showing any dependent children is irrelevant.
Where immigration is concerned I just don't like making assumptions :wink:
