HSMP extention - maintenance / in wait work rights - HELP!

HSMP extention - maintenance / in wait work rights - HELP!

Hi,

I have a two year HSPM visa, which is due to run out in July. Before that I was on a work permit. Like an idiot I didn't realise the rules had changed, and that I would need to show the 800 maintenance over three months - this has never been the case when I've applied for visas before. When i realised this was the case, it was about two days under three months before my visa runs out. I immediately put 800 into my savings account, and will be able to put more into it each month, but will need to apply before my visa runs out, which will mean I'll be a few days short of the 3 months. I had literally just returned from a holiday back home (NZ) before checking the process, so my current account isn't as healthy as healthy as it should be either! I have two questions:

1.) Will being several days under the three months mean I am refused, even if there is about £1500 in there?

2.) If I apply for the visa just before the deadline, does this mean I cannot work until I (hopefully) have a successful result? Or is it some sort of limbo situation?

HO is very strict in that rule... PPl got rejected even though they got a few thousand pounds but was short of two or three days...

Nope... As long as your case is with HO u r eligible to work according to your previous visa....

Do you not have monyt in any other account for the period(days) of the shortfall? You can use two or more accounts for maintenance funds. You don;t need to have money in Single account.

1.HO is very strict and your application will be straightway rejected if you fail to show sufficient maintenance funds.

2. You can continue to work till you receive you visa result back.

so that basically means I'm screwed right? Man, you'd think they should send you an email or something telling you the rules have changed. So if I apply after my visa has run out I'm back at the beginning? My only option is now to get sponsored by my boss, I guess.

Well you can show savings (ISA, Online saver etc) or if you have funds available in any overseas account. Try to combine as many as accounts possible to cover the dates for which you have gone below.

Well we can blame HO for changing rules so often but at the same time it is the responsibility of the VISA holders to keep an eye on changes in VISA regimen. Changes to HSMP has been covered widely in the media and has been a politically contentious (debated as well) issue.

Anyways, you need to think of what your options are. See if any of the suggestions by other members above are plausible.

Dude they did implement that maintenance thing ages ago.. Infact thats the biggest cause of refusals...
