WP to Tier 1 (G) Rejected - Advice please

Post by MattM » Sat May 16, 2009 1:26 pm

My Tier 1 application came back rejected today.

Unfortunately, my company pays my expenses and salary in one transaction. Therefore, for four months the amount paid listed on my bank statements is more than the amount listed on my payslips. So, essentially the HO decided not to recognise four months of pay on my application.

Is there any recourse as the form says that there is no right of appeal? Or can I still go and see an immigration lawyer?

Thanks in advance.

Matt

Did you have anything else to explain that your employer paid you in that manner, e.g. a covering letter and/or a letter from your employer confirming this? It does seem harsh to reject your application for being paid (effectively) more than you had been claiming for, but the guidance is clear in that the evidence from bank statements and payslips should match. I would have thought that a simple letter would have sufficed as explanation for this.

If you hadn't enclosed an additional letter explaining this, then I'm not sure if youu can do anything other than resubmitting youur application. Do get legal advice by all means, but I suspect that you may just have to reapply.

Good Luck!
