Citizenship with traffic offence

Post by senthil78 » Wed May 27, 2009 12:25 am

Hi All,

I have recently got my ILR. I will be applying my Naturalisation next year. I have read all the requirement for naturalisation and i found about traffic offence. I need some clarrification about one incident that happened two years ago, A police officer stopped me on the motorway when I was driving with my indian licence (also holding provisional UK driving license). I thought that my indian licence is valid for a year everytime from the date of entry into the UK. But I was told by police officer that my indian licence is valid for a year from the date when i first entered into the UK, hence my licence status was provisional because i was holding UK provisional licence. I received court notice and i went to court for hearing where I got 3 points on my licence and 60 pounds fine. The DVLA offence code was MW10 (Contravention of Special Roads Regulations (excluding speed limits))

I applied for my ILR recently and granted ILR. Will it be considered as a minor fault? Will it affect my citizenship?

Can you guys please help me?

Thanks..

You have to disclose it since it was given in court.
It may or may not affect your application - dpending how the HO will classify this offence. Don't think there is certainty either way.

"You must give details of all criminal convictions both within or outside the United
Kingdom. These include road traffic offences, but not fixed penalty notices which have not
been given in a court. Fixed penalty notices include parking and speeding offences. Drink
driving offences must be declared."
