EEA2 Working in UK and Marriage Questions

Post by patricksb » Thu Jun 04, 2009 9:00 am

Hello,

I am a Canadian living in UK, my partner and I, who is Italian, will be getting married in an Anglican Church and I was wondering what the best approach would be for residency, I have been doing some reading and found that it would be in my best interest to use form EEA2, please advise.

Also, at what point am I able to work in the UK after our marriage or is it possible to work prior to this, can I work while my EEA2 form is being processed, I am currently here on visitor visa.

Thanks in advance

You can't work on a visitor visa. You will have to wait until your marriage. After that you can work immediately but the problem may be to convince a prospective employer that you have this right. They may want to see a CoA (=certificate of application, that is the confirmation letter that you will receive from Home Office) at minimum. But some found it even difficult to impossible then.

Thanks for the quick reply, so I will have to wait it out, was I correct to assume the EEA2 form is the proper form for me?

Yes!

Another quick question, does my fiance have to submit the EEA1 form or does that matter? If so, now or after we are married?

Again, thanks for the replies, very helpful site

Both EEA1 and EEA2 (though in practice you will need it, see above) applications are optional. Your partner can apply any time (assuming the conditions are met).

Yeah, I figured I read that somewhere, that my partner may need it but it's not a requirement, confusing.

Another question, the more I read the more questions I have, it's states that we have to register our marriage but then states that we have to have Certificate of Approval before registering our marriage, then says that if we are married in Church of England that we don't require COA, do we still have to register our marriage, just don't require the COA to do it or do we not have to register all together, this is exhausting
