US married to EU citizen how can he stay in spain

US married to EU citizen how can he stay in spain

I am a UK passport holder in Dec I married my american husband in america when we travelled back to spain (Lanzarote) we assumed we could register him easily but I contacted a lawyer and she advised we would have to travel back to the states and he would need to get a visa from the spainish consulate then come back to spain again.

Is this correct?

As an EU citizen you AND your husband (regardless of what citizenship he holds) have a right to live in Spain. No ifs and no buts about that....
You may need to involve SOLVIT (Google will give you their web address). They will help you deal with the Spanish authorities if needed.
He does not need to travel back to the US to get a visa.

Where are you both now? Are you working or studying in Spain?

I suspect your lawyer is not very knowledgeable about this area of the law. You should read carefully about Directive 2004/38/EC, which governs both your rights and your husband's rights.

The bottom line is it should be about as easy to register him as it was to originally register you in Spain.
