A non-EU citizen marrying a Spanish National-Certain queries

Post by indianocean » Sat Jun 27, 2009 9:25 am

Hello,

I am an Indian national residing in India and my girlfriend is a Spanish National residing in Spain.

We plan to get married early next year in Spain. It would be a civil wedding. The plan is for me to go to Spain on a tourist visa with the essential documents required to get married there.

The queries that I have are…

1. Is it possible to do what I have just mentioned?

2. If yes, would I need to go back to India before the tourist visa expires and then apply for residency (to live and work there) in Spain from India by approaching the Spanish Embassy in India?

3. If yes, How much time does it take for the residency permit to come through before I can move there?

4. Do I need to have spent a minimum amount of time in Spain to be married there?

5. Would the process be easier if the marriage is registered outside Spain (in India) and then apply for residency in Spain?

Would be grateful if anyone could answer these doubts I have.

Thank you.

A 'tourist visa' is a Schengen C visa. To obtain one you would have to proof, in principle, your intend to return to your country. If you intend to marry you probably won't. Please note, however, that I do not know how the Spanish handle such cases. Possible that they issue a separate marriage visa.

Right, am aware of the Schengen C visa and as you said, I need to show a return ticket at the time of visa application. But, if I needn't return, then i would rather stay on inspite of having a return ticket.

It might not be just a return ticket. 'Intend to return' may also mean good and stable job, property, family ties, etc. But I hope someone else can advice you if the Spanish have no problem with visa nationals
marrying in their country.
