Employer refusing for sponsorship -Moderators pls hlp

Hi All,

I am in a Post Studty Work VISA and it expires in March 2010. I am currently working for City Council. I wanted to change my VISA to Tier 2 general, where I am completely eligible. I am not eligible for Tier 1 General (HSMP) VISA because, my employment will be less than one year and my earing doesnt match.

My employer (HR) doesnt want to apply for the sponsorship.. They are saying, no plans to become a licensed employer with the Home Office as historically they have been able to recruit from the resident labour market.

I am switching from PSW to Tier 2 General and there is no need of resident labout market test, still my HR is saying this again and again...

What can I do now?

Is there any policy that will make the employer to apply for the sponsorship? Do I have any right's to make the HR to apply?

Please guide me in this regard.

You can talk to the employer and try to convince. They are not obliged to apply for sponsorship.

No u can not force them to apply for the licence and you do not have any rights to force them to apply for you. The only thing u can do is to put a request in or speak to your line manager or look for a company which already have a lecence and can give u a job.
