Can Any one give me a suggestion , I don't care how small it is it may be useful.
I have finally divorce from my EEA partner and just to find out what document do you guys think I may have to sent it to HO , I do not have proof that she was working for the whole 3 years because she wanted to finish her A level in france but she was still registed here because she was here all the time with me and last year Aug 08 she came here finally to stay with me but unfortunatley we had problem all the time and ended the marraige so the only proof I have now is bills for both of us and proof that she was working during the time of divorce and she is still working now . We are good friends and she is willing to help me for any document . she has been working here since Aug 08 till when we got the finally degree from the court. I did not know I have to show proof for her working for 3 years or 1 years .

You have to have married for three years, one of those 3 years should have been spent in the UK.

You need evidence that up to the time the decree absolute was issued, she was exercising treaty rights in the UK.

Have you got evidence she was exercising treaty right in any capacity in the 2 years prior to the third year preceding your separation.

Bank statement, evidence you lived together will be vital.

Obie thx for ur reply , as I mentioned early I have provide that we were lived tother for 3 years bills , but because she wanted to finish her study in france and come back here finally she was not working but still registed living with me . She has beed here fully working since August last year and I start the divorce in November got decree absolute in may this year . Do you think I have chance of retained my own rights? if not I can start think of doing something else . She is willing to help .

guys, i need a little advice in here..

got married with an EEA on the 06-0e9-2006 the date on the divorce petition that was sent is the 24-08-2009 which makes it 2 year 11 months and 18 days.. so 3 years less 12 days!!!!! how would that affect my application for the residence retention after divorcing an EEA national??????????????????
