My son and his family (wife and 2 kids ) and myself are British citizens.
We applied for my husband's settlement visa which was refused in Jan 09.
The main reason for refusal was -
1) There was no Evidence of National Insurance contribution
2) That my Employment is Registered with the local Inland Revenue Office
3) There is no reasonable evidence that the accomodation is suitable or big enough.
4) no supporting evidence to show salary deposits to bank accounts.
I work for my son's company that pays me a monthly salary. When the application was made, my income was below the NI and tax threshold. Hence, I was not liable to pay any tax and NI.
I dont understand why they have pointed out 1 and 2.
Regular salary was being remitted to my bank account. My bank statements supporting this were submitted. What could be the reason for reason 4?
The property we stay in is a 2 bed property. NHBC and land registry documents were submitted with the original application. Wonder why this was pointed unsatisfactory.
Could you please let me know what the following statement in the refusal letter means -
"whilst it could be reasonable to accept them as evidence of genuine employment, they are not in a condition which reflects their claimed age."
We made an appeal with more supporting documents (property survey, mortgage statements, etc....) in Feburary 09.
The case will now be heared in October.
In addition my situation has also changed.
1) I now pay NI and Tax as my salary has been increased.
2) My daughter who was living with my husband has migrated to Sharjah. So my husband is alone in Mumbai.
3) We have a property survey report which clearly states that there is enough space to accomodate all of us.
Some facts -
My Husband sufferred a heart attack in 2007 when I was in the UK and I had to rush to Mumbai.
He recently also had a cataract operation done.
He is 64 and cannot live alone without family.
Could you please let me know, with the change in my situation, the facts and additional documents, will the case meet a positive end?
What will I be questioned at the hearing?
What documentation should I prepare for the hearing?
