work permit revoked, overstayed and applying on spouse visa

Post by project » Mon Sep 28, 2009 10:32 am

Hi All,

This forum has given me a new life and i am really looking forward to your replies. Please

I got married in May09 in my home country to my wife who is a british national and we know each other for the past 5 years. We met in London and its not an arranged marriage.

Basically i entered UK in Jan03 on student visa. Secured a work permit in 2004 but work permit was revoked in 2006 due to my employer had more than 50 companies registered and was some kind of bogus businesses.

During this time i completed my ACCA, Bsc (Hons) and also completed prince2 (project management practioner).I was continuosly in correspondence with the home office for requesting re-review of my application. I also started my MBA and applied for a student visa which was refused.

Me and my now wife also applied for a COA which never got responded for nearly a year and then we had to ask for my wife's passport back.

In 2007 I applied for a judical review against the curtailment of work permit which is still not decided.

My solicitor in mid 2008 introduced me to the concession (15 march – 1 oct) and advised to apply from my home country. I left on 20th sept08. After my marriage I applied in June09 on the basis of spouse visa. Still not heard back after 14 weeks.

My application had all the relevaent docs attached (sponsorship undertaking, spouse bank statements of more than £8K savings of 6months, her pay slips, P60, employement reference letter, tenancy agreement, surveyor letter, council tax bill, marriage certificate, marriage photos, photos in 2004, emails 04-05, my evidence of leaving UK on 20th sept08, my educational docs and work experiences in home country, my bank statements of £10K, my construction business in home country).

I am really worried about the outcome. Please let me know your assessments and most importantly do I fall under and deception or 320(11).

cheers

some people have been waiting for more than 14wks,and they got their visa in the end. i wouldn;t have thought it be much longer now..

but i think after 14 wks you can ask the embassy about the progess (or lack of it) of your visa app.
