not certain about spouse visa

Post by goodman24 » Thu Oct 15, 2009 12:57 am

hello there everyone,

I travelled with my wife to my home country in september 2008 in order to get married and live together in the UK. my wife is British and we met in the UK. In 2007 we applied for a COA to get married in the UK, but for some reason we never recieved the certificate. we applied in May 2007 and my visa run out in June 2007. But I resigned from the job before my visa expired. I overstayed in the UK while I tried to sort things out, and had been living with my aunty in her property in london. we eventually came to my home country to acquire the visa.

I was refused the visa on maintenance and accommodation grounds, and the ECO said my wife can join me in my home country. I have been through the appeal process already but some viatl info i submitted was taken out and not before the judge so my appeal was dismissed.

my wife and i have decided to apply again and rectify all the loop holes raised by the ECO in the refusal notice. but the issue is that she has just given birth and cannot work because she has to care for the child. She lives with her mother in their house. But i have a job offer from a previous company I worked for in the UK and also have some funds in my account, which when converted is a few thousands in pounds.

will this work out for us and is there anything we have to know or have to make this application successful. Do I also need to explain what i was doing in the UK when the visa run out. your help and advice is very much appreciated.

ta.
