Complicated situation student to unmarried partner

Post by gaman » Sat Jul 16, 2005 8:43 am

I need some help as this case is not straight forward.
I tried hours looking for anything similar but still find this case different so I need help here please!

A good friend of mine(known for 8 years) who a is British citizen and was married sponsored for my visit visa for 2 months.
I am a visa national
Visited the UK on visit visa for 2 months in Nov 2003
When I met her at the airport she told me she was divorced
I stayed with her for 2 months and nearer the end we got together
I arranged a 2 year course in the UK and applied for student visa after I went home from here.
I knew just before applying from my home country that my partner was pregnant
I didn't mention anything about it during my student visa application
She sponsored me as a friend and provided accommodation in her house
We have a baby now
We wold like to live as an unmarried partner and don't really believe in marriages but we are for sure now that we are going to be together as a family for life
I would like incountry switch from student visa to unmarried partner
I have read extensively about it and I know that it must be 2 years together before I can apply

I have 2 questions mainly and my main concerns once again are-
I came in November 2003 on a visit visa and went home after 2 months.
I didn't mention about my sponsor being my partner or pregnant with my baby when applied for my student visa abroad.
Because it was early in the stage I am planning to say that I didn't know about her being pregnant (I know this is not right ..) and apply for incountry switch to unmarried partner visa.

Will I be rejected for not disclosing during my student visa application? and taken as deceiving to get into the country? I am attending all the classes and passed my exams in terms of my studies.

Can I apply in Nov 2005 (2 years - but that was a visit visa and I did not tell the authorities when I apply again later for the student visa)?

Where (in the UK or my home country non-EU) do I apply for unmarried partner visa for a better chance and less complication?
Thank you

I arranged a 2 year course in the UK and applied for student visa after I went home from here.
When was that? You have a two-year student visa? When did that start? What is the expiry date?

After your two-month visit starting in November 2003, how long were you back in your own country before returning with your student visa?

That additional information will make it easier to answer your query.

Of course you will appreciate that marriage and then application for a spouse visa would be a much easier route to go down, from the visa point of view, but the last thing anyone should do is marry simply to get a visa.

My reaction to what you post is that you cannot possibly claim to have lived together for two years until March 2006, so cannot think of applying for Unmarried Partner's visa until March or April 2006.

Thanks again

Will it be easier to apply from my home country or it doesn't make much difference if I apply here in the UK?
