Husband visa

Post by saminkhan » Tue Nov 17, 2009 10:50 pm

My sister lives with me with her 4 years old daughter. She is planning to get married with her fiance who is in Pakistan. I would really appreciate if any of you could help me clarifying the following issues:

Both of them are living with me for the last 4 years. She doesnt pay for any accomodation relating costs. I can afford and can arrange for a bigger house accomodating her, her daughter and her husband. Would that be acceptable by home office?

Is there any requirement for her name to be shown on the rent agreeement.

Is there any need for her to pay any rent.

I know that as she is currently on low income, she'll have to look for full time work but what will be an acceptable level of salary she should be looking for.

Thanks

Samin

If you have a spare house and want to let her stay there rent free, then that would be acceptable. If she was to rent her own property, you can not pay her rent ( as this financial assistance - which is not allowed)

Yes whether its your house, or she rents it from someone

Is there any need for her to pay any rent.

If its your house then no, but if it is rented from someone else, then yes

I know that as she is currently on low income, she'll have to look for full time work but what will be an acceptable level of salary she should be looking for.

She should be looking at an annual income above £12000 per annum to stand a chance of supporting herself and family and paying of bills and rent etc

Thanks

Thanks batleykhan for your quick response.

I couldnt explain it properly in my first question that I was planning to rent a bigger house i.e. 3 bed which will enough to house 5 people including me, my wife and my sister's family including her husband. As you know joint family is quite common in asian family but i am not sure if Home Office accepts that.

Does it change any of your earlier answers.

Many thanks for your help

Yes it does, if your property is deemed to be overcrowded.

Click this link to check whether it will classified as overcrowded or not

If it is not deemed to be overcrowded , then it is acceptable for immigration purposes, but like Wanderer has stated if your sister can contribute something towards the rent it will be beneficial for her application

Your sister doesn't have to contribute to the rent...as when if she joins the household this won't increase in cost. However, you should show that you will pay at least a nominal amount towards basic household expenses such as food.

Thank you all again for your responses. One last thing if you could help me with is the child benefit. Once she start working full time, her other benefits will fully stop except child benefit which wont. I have seen some guidelines about the definition of public benefits but just wanted to confirm if continuation of child benefit can be of any problem.

Thanks

Hi saminkhan,

your sister can claim the benefits she is entitled to in her own right, for example even if she gets a job she may be entitled to Working & Child Tax Credits.....if she calls the helpline up they will calculate everything she is entitled to.
