Hi All,

My 1 year Work permit expired on 2009 October end. My company has applied for sponsorship on September end. It hasn't approved yet. Our plan was for renewing my visa on October end. But we couldn’t. I left UK and supporting the same job from India.

Company will apply for certificate of sponsorship on getting sponsorship.

Initially I got this job after conducting job market test during 2008 period.

There is no change in job or pay. All my education, minimum balance etc are ok. My job is not short listed.

Now as I left UK do I need to again appear for job market test for getting certificate of sponsorship under Tier 2 General category?

While in India, suppose if there is any change in pay does it will cause problem while applying for certificate of sponsorship or visa?

This is confusing!

Whilst you are in India, are you being paid the same salary as you were paid in the UK?? I dont know how the UKBA will treat working from India as continous employment.

I think you can apply for Tier 2 under transitional arrangements if you are working for the employer in the same job for which your work permit was first granted, without doing the resident labour market test again.

However, I think in your case, they need to raise a new Certificate of sponsorship after doing a "fresh" resident labour market test and you meeting the points requirements under Tier 2. You cannot use 2008 labour market test..

and yes, drastic change in pay (lower or higer) will be in issue while applying under transitional arrangements.
