I am a 25 year old british woman married to an 27year old brasilian man.

I meet my husband in england the beginning of 2008 once he told me he was illegal in the country and explained everything, we both decided it would be best to go to brasil before our situation got any worse.

So i spent 6months with him in brasil, until my visa expired and had to return to the uk, now 6months later i returned to brasil to marry him,

but i really want to live in england as much as it is lovely in brasil it doesnt meet my needs or life style.

but the problem is my husband was first declined a student visa to england in 2007, so with this took it upon him self to go there anyway illegally..he wanted to study our language as to better his chances of a good job he would enjoy in brasil!

There was no reason for his visa to be declined. He had more than enough funds to support him and had paid for his school in england to study! And his own restaurant.

but not long after he entered the uk he got deported and had his finger prints taken!! but these prints are under a false name...

JUST the name! he DID NOTshow any false documents of any sorts just told them his name.

then later, he returned to uk again illegally for the 2nd time that is when i meet him and we left uk together he was not deported!


So my question is if we apply to go to uk will his finger prints come up in the system?
will they decline him entry if they do or find out he used a different name?
(however the name he used was very similar to his own name just a small difference which could have been mistaken with his bad prononcation of english at the time.)
should we tell them the truth of how we meet?
tell the truth about him
what would be the best way for us to go to uk together?

Some help would be very very grateful!!

You can be quite sure that his fingerprints will identify him as the previous removal in another name.
He has absolutely no alternative but to give a detailed and truthful account of his previous immigration history, so that he can not be accused of making false statements on a visa application. Applying as a spouse is more likely to be successful than any other type of visa application, but success is far from guaranteed. Having used a false name and twice entered the UK illegally after being refused a visa, he is likely to be refused because he has "previously contrived in a significant way to frustrate the intentions of the Immigration Rules" under Para 320(11).
You had best consult an experienced immigration solicitor, and be prepared to fight an appeal on this one.
Alternatively, go back to Brazil and live with him there for a few years. What about that good job he was going to get there as a result of studying in England?

Thank you rusty, what you have told me i pretty much knew any way so therefore the only other option for us is to stay in brasil.. i am already here.
I just did not want to stay here, as for his job here he will for sure go a head with it.

Do you have and recommendations of immigration lawyers that are reasonable in expenses?
