Spouse visa rejected.... Appeal Grounds??

Spouse visa rejected.... Appeal Grounds??

Hi,
My spouse visa application has been rejected, for the following reasons

"You have stated that you relationship began on 24/07/2009 when you married your sponsor. You have never been married and state that this is an arranged marriage, I note that your sponsor is divorce with 2 children from his first marriage, I’m aware from your local customs that your marriage would not normally be considered a good match for you, you haven’t shown any evidence of contact between you and your sponsor or that you in a subsisting marriage, in view of this I’m not satisfied that you intend to live with you spouse in the UK, you have not submitted any evidence to show that you have met your sponsor and I’m not satisfied that you are married to a person present and settled in the UK"

It was also mentioned that,

‘You have submitted evidence to show that your sponsor is employed, however, the bank statement submitted shows that your sponsor is overdrawn,’

Also,

‘It is unclear from the evidence submitted that your sponsor is in a stable financial position in order to maintain you without recourse to the public funds.’

&

‘There is nothing in English law which prohibits your sponsor from travelling to Pakistan where you currently live and enjoying family life with you in that country.’

I Just want to know what Grounds shall I mention in my appeal, I'm certain I can use Human rights grounds because my spouse has two kids who spend 3 nights a week with him , we also have 3 months bank statements to show that account is not overdrawn anymore, plus over 100 text sent during last couple of months to prove we have been in contact with each other,


Do I have a chance if I appeal??????

Of course you have a chance, but in the meantime build up more evidences .

Yes , u can use the human right law to show that ur husband can t move to ur country...

Do you have a marriage certificate??

when was the refusal??

Yes I do have a certified marriage certificate, which was submitted,
It was refused on 18th,

What other evidence we should be considering??

you haven’t shown any evidence of contact between you and your sponsor or that you in a subsisting marriage
As I see it, this is your main problem ... lack of "evidence of contact". And now, you in one country and your husband in another, what evidence is there that the two of you are keeping in touch. The onus is on you to prove this, and I suspect with your application you failed in that endeavour.

ur case doesn t look bad AT ALL .
There is nothing in English law which prohibits your sponsor from travelling to Pakistan where you currently live and enjoying family life with you in that country

ur huband can t leave in pakistan cos he has children who spend 3 nights a week with him in th uk show it
It is unclear from the evidence submitted that your sponsor is in a stable financial position in order to maintain you without recourse to the public funds
not be overdrawn is not enough he has to make sure that after the alimony for his children bills and so on he will have enough to support u.

build up more evidences of contact (email , phone bill showing that u r regularly in touch etc ...)

A statement demonstrating that is not true ...
the decision will be easily overturned by the end of next summer.
Just take it easy , be patient . u will see ur hubby :D :lol:

The kids and human rights won't actually help the wife though because she doesn't need to be there for that. You have no chance with the human rights side of it.

John gave you the best response and that's the one that you should concentrate on.
