4 yr marriage rule

Post by alizz » Fri Dec 25, 2009 4:28 am

Hi all,

I have a question about the residential qualifying period. One of my relative who is married for almost 12 years with 3 kids and her husband have an ILR. My question is that does she qualify for an anything inorder to come to the UK with her children?
Basically she was fine living in her home country while the husband use to send her money and visited every year for couple of months but now as the kids have gorwn up (oldest is 10 year old) she thinks that its better if they live together as a family.

Thanks very much in advance for answers!!! I really appreciate it.

She may apply for a spouse visa endorsement perhaps with special entry conditions (one requirement is that they were living together outside the UK for at least four years).

Her non-British children may apply for child settlement visas.

Subject to the maintenance and accommodation requirements.

can you apply for visa to stay in the UK on the basis of having a British half sister? I ask this because the husband has a daughter in the UK from a previous marriage.
