Parents divorcing - Access to uk born child

Post by lostintears » Tue Dec 29, 2009 12:19 am

Hi all,

Wondering if anyone can help me. My wife is a british national. She sponsored me to the uk on initial 2 years spouse visa which is due to expire in 4 months(April 2010). We also have 4 months old child who is a british national because of her mom.

Unfortunately our marriage seems to be coming to an end. She wants divorce. She is trying to do this deliberately now so that i have to leave the country & have no contact with child. Looks like we might have divorce before i can complete 2 years spouse visa.

I still would like to live in the uk so that i have access to my child. Is there any way to deal with this situation? Is there any way i can apply "indefinite leave to remain".

I would really appreciate your advice on this matter!!!

With Regards

Yes there is a way to deal with your situation..

1.Go to family court and apply for contact order
2.May be you qualified for legal aid..go to solicitors who do legal aid and see would you qualify...

When your contact is started ..apply under visa category person exercising access rights to his son under paragraph 248a of immigration rules..
