Question about job seeker's allowance for EEA3 Application

Hello to Everyone,

I would like to get some opinion to my question related to application EEA3

I would like to apply for Permanent Residence in couple weeks time and I’m really confused what status is better to apply with in my situation?

Since 01/02/2005, I was studying and working in the UK (date where my WRS was registered). I can prove my resident status without any problems until 30/09/2009 (throughout the employment and full time studies).
However, I finished my studies on 01/10/2009 and I have been looking for a job since then. I live with my partner (he is British) at the moment who fully supports me financially. I don’t pay any utility bills and don’t have any tenant’s agreement whatsoever.

Should I apply as an economically self-sufficient (I have taken a full comprehensive insurance from 01/01/2010) or should I apply as a job seeker (I’m looking for a job since 01/10/2009)? Which is the better option???

Moreover, I’ve submitted my application for Job seeker's allowance. If I want to proceed with my application I have to give a call to job center as soon as possible! Do I need to register for this benefit at all?? I'm totally confused and don't know how job’s seeker allowance will effect my EEA3 application?? Would it give me positive or negative effect on my application?? I have never registered with a job center before. My partner will support me as long as I need to, so I don't really need or want any benefits from the UK at all! If I would register it is only for my application purpose. Is it good idea to register or NOT?

I've been applying for the jobs and got some rejection letters (emails) or invitation for the interviews (again emails)!

I would be very grateful for any your help or thoughts!!

The problem with your EEA3 application may arise where there are gaps in you exercising treaty rights:

After your study on 01 Oct 09 you should have either registered immediately with your local job centre as a job seeker OR if claiming self sufficiency, gotten comprehensive sickness insurance from 02nd October 09. When did you apply for JSA?

Hey thanks for answer!

I'm trying to claim benefit from 01/12/09 (apparently it is possible to do with earlier date!). I have taken some health insurance from 01/10/09 but it is NOT comprehensive!!! would you think a two month gap ( If i managed to claim JSA from 01/19/09) would be a big problem with Home Office?

Gedis, any particular reason you are making the EEA3 application at all? What advantage do you perceive getting PR status will give you?

John, I'm applying for EEA3 because I think it makes me easy to apply for naturalization and citizenship? or am I wrong? I want to swap my passport to British one in the future. :roll: :roll: :roll: :roll: :roll: :roll: :roll: :roll:

Just looking at the employment, the term the EU Directive uses is that you are a Worker, you don't stop being a Worker just because you are currently unemployed, but look at the detail in Article 7.3 .... click here

So are you still defined as a Worker?
