Another Question (while entering)

Post by metal » Tue May 04, 2004 7:20 am

Hi,

An ancestry visa was granted to me a year ago. Its only now that I am able to move to the UK.

1. Will the Immigration Officer at the airport allow me to enter the UK for four years?

2. Will the Immigration Officer at the airport transfer my visa to the new passport? (The visa is in the expired passport that I have in my possession)

Thanks
Metal

1. No - he/she will just stamp your passport (the AV visa page) with a rectangular entry stamp showing date, Port of Entry and his/her number.

2. Maybe but IMHO unlikely - anectodal evidence on the board and personal experience from friends show that IO's are no longer routinely transfering visas from expired to valid passports at a POE. Requests for such are being met by the comment to apply for such a transfer through the Home Office after entry into the UK - general consensus is that this is in line with government policy to introduce a charge to transfer visas to a new passport as proscribed in the new immigration bill currently before the House of Lords. Ask the IO and see what happens - you may get lucky. The worst he/she can say is No. Tell us how you got on though :) .

3. You are elgible to apply for Indefinite Leave To Remain in the UK after 4 years in the UK on an AV - you have wasted/lost a year. You need to apply for another AV or switch to another category leading to settlement to make up the 1 year - the only visa status complimenting the AV in terms of flexibility is the HSMP and even that is for a specific profession - you could do 'pot washing' on an AV and still get ILR.

Bon Voyage
