UK Settlement Visa Issued - Departure delayed

Post by UKGuyLondon » Wed Feb 10, 2010 9:33 am

Hi everyone.

I had applied for a UK Settlement visa for my wife and 2.5 yr old son in mid July, 2009. Alhamdolillah, they both got it approved in begining and end of Dec 2009 respectively.

At the time of application, my wife was pregnant and delivered in October end. My mom also passed away in December '09 so our minds were not on leaving Pakistan. Now, we have started our mission to go to UK again and are in the process of applying for my daughter's UK settlement visa.

Problem is that by the time my daughter's settlement visa comes through, it will have been about 6 months from the time my wife and son's was approved.

My question is, do I have to somehow inform the UKBA why I cannot leave? I have genuine reasons since my wife cannot leave our 3 month old daughter in Pakistan alone. If I do have to inform them, who do I write to? UKBA are ike ghosts, can't figure out how to get an answer from them! Can we be stopped at the immigration counter at the airport for entering late?

Sorry for the long email but I am so tense. Would really appreciate guidance / counselling. Thanks in advance

Read this topic particularly Johns comments about your child and then come back and let us know what you think.

It maybe a case that when your child id born, he becomes British as you the father is British

Thank you for your reply Batley Khan.

Unfortunatley, I am British by descent so my daughter cannot apply. I have also not lived there for a continuous period of 3 years else I may have still been able to apply for her UK citizenship.

Can you kindly suggest if I need to inform UKBA right now why I will not be able to travel even though my wife and son's visa has been issued or is that fact that they have a 27 month visa good enough for their entry to the UK? Once there, we will apply for FLR to complete the 2 year period.

Thanks in advance

I don't believe there is any need to inform UBKA of the delay in your (and family's) departure. They can enter UK anytime during the validity of their visas.

I think all you need to ensure is that you (sponsor) either travel with them to UK or are present in UK on the day they enter UK.
