I am struggling to get a straight answer on this from the hotline so hopefully someone can help me.
My wife is a Polish national and I am a British national. We were married 4.5 years ago. She entered the UK on a student visa in 2002. After that she had business visas up until Nov 2004. I don't know if they were business visitor visas (as I keep getting asked), but I do have them in her passport and they say "CGK" followed by a number and then "Leave to remain in the UK on the condition that the holder maintains and accomodates himself and any dependants without recourse to public funds, does not enter or change employment paid or unpaid without the consent of the Secretary of State for employment and does not engage in any business or profession without the consent of the Secretary of State for the Home Department is hereby given <date>" and stamped by the Home Office.
After the last business visa expired in Nov 2004, Poland had joined the EU and she didn't need a visa any more. What she didn't do at this time and what she should have done (I think) is register as a worker under the WRS scheme for 1 year.
She has worked since 2003 for large companies and none of them requested that she was registered under the WRS so she never registered.
Now she wants to apply for citizenship and I'm trying to ascertain whether we first need to register under the scheme and then wait a year before applying.
She has been resident in the UK with me for seven years and paying NI etc for this long as well.
Does anyone know the answer to this? Thanks in advance for your help.
