Set (M) - Proof of co habiting/ gap on husband's wages

Hello everyone,
I will be submitting my Set (M) application in the next two weeks and a few queries came up.
1. My husband and I have lived in his mother's house (paying rent) for over 2 years. All the utility bills are under her name still and we do not run a formal rent agreement. All my bank mail and his, as well as mobile phones etc are in the same address. What would be the best way of presenting this situation?
2. We have all the bank statements over these years from both of us, would being overdrawn count against?
3. He was working for 4 months in Belgium last year, which will show a gap on his wages here and taxes. Explaining this in the cover letter with the P60 and 45, would be sufficient?
4. Also he has a trip planned 8 weeks after my submission. Knowing that there is the chance of the process taking longer than this, is there any chance I can withdraw his passport only, without interfering on the decision?
Any help will be much appreciated.

1. If his mother owns the house, she should write a letter to UKBA that you and your husband reside there, from start date, and how much rent you pay. Your bank statements would also be a proof of address.
2. No, as long as neither of you rely on public funds.
3. I would personally include all his payslips both in the UK and Belgium and include the information in the cover letter.
4. Not sure of this. Maybe it's best you go to PEO rather than a postal application.

Thank you so much. Lucky just managed to book an appointment for Saturday 20th - Croydon, this is the exact day my 2 years visa spouse expires, is that too late?

You should be OK, unless another earlier available appointment comes your way, attend this one. Just make sure your documents are complete, photos are the right format, bring a personal cheque in case their card machines don't work that day, etc.

Also, I think they would expect your husband to also attend.
