Dear All,

I am currently applying to migrate to Australia as a Skilled Person and I should be eligible for the Permanent Resident visa, if everything goes well.

I have a problem with finding the correct answer to the question in the application form "Have you ever been excluded or asked to leave any country". Due to my unusual situation I am in I could answer both "yes" and "no". "No" to the first part of the question and something like "yes, maybe, maybe not, don't know" to the second part of it.

I just wonder if this question is potentially fatal and if anyone had the reason to answer "yes" to that question, would visa be automatically refused? Have there been any known cases like this?

My direct query to DIMIA about this has returned no reply.

Unfortunately given your current status as a result of the problems at HO - you would have to answer YES to the question..

..I think this would be detremental to your application.

Even if you wrongly answered NO; how would you apply for a VISA at Australia House? (because your ppt would show that you were out-of status longtime ago)

Jeff,

If it is the case you were required to depart the UK then state Yes. It will not impact negatively on your application though Oz house at interview will need relevant details. Best to include such in the application form with appropriate correspondence and also an explanation of your current basis of remaining in the UK.

Well, my Aussie migration agents believe it won't given the circumstances I am in. But they advised to write a letter to DIMIA explaining this.

Well, I was told that visas under Skilled Migrant class are granted without interview. After ASPC has considered all the criteria and found me eligible under the rules they usually dispatch the e-mail advising on this, then you simply send your passport to the relevant embassy. Unless, of course, they decide to speak to me in person on that particular matter. But I will certainly take your advice and answer "Y" to this question and include the letter.

My passport will show nothing, it will be merely a blank passport. My old passport was taken my Immigration Service in 1999.

Unfortunately, not yet. Still awaiting my PhD viva with subsequent application under HSMP, however, decided not to live in the UK for long (of course will not be informing the UK immigation system on that), had too much and do not believe in this system. Perhaps will get my HSMP first before the time for lodging the Skilled Migration application with DIMIA comes.
