Unsure of direction to go.... Settlement/Work Visa?

Hoping someone can give me a little direction on how to proceed.

I have been in a two year long distance relationship with a wonderful woman, who lives in Swansea, Wales. I live in Chicago. We are looking to take the next step in our relationship and get married. Also, she is also five months pregnant. I would have made a push to have her move here to the states, but she a doctor (educated in Poland) and the US would require years of re-certification, so it makes sense for me to join her.

I thought that a settlement visa would be the way to go, and I had hoped that my current employer would allow me to work remotely, but they denied my request. It’s my understanding that you are unable to work under a settlement visa for the first six months. Unfortunately, due to financial reasons I cannot be out of work for six months. If I get approved for a settlement visa, can I return to the US and continue to work and come back to the UK and look for work after six months, or must I remain in the UK during those six months. Or should I look into a work visa?

UK has two types of Work visa, Tier 1 with which you can work for anyone, needs a Masters, or Tier 2, tied to the sponsoring employer, need a Bachelors degree.

So realistically u'll need either a Masters or a sponsor.

Is the lady in question Polish or British?

If your lady friend is a British citizen then you may apply for a settlement visa and if granted you are allowed to work as soon as you enter the country.
Read the rules for settlement and see if your circumstances allow you to apply

mochyn - can I just query your assertion there.

I see 4 possible routes ... ASSUMING this lady is british.

Tier 1 - need good qualifications - but having the lady friend here makes no difference - can work on arrival

Tier 2 - need a sponser - but having the lady friend here makes no difference - can work on arrival

Unmarried partner - would be able to work on arrival - but need to have been in a relationship akin to marriage - which they clearly haven't - so that rules this out.

Fiancee - possibly easiest if they are happy to get married. But wouldn't be able to work on arrival - would have to wait until after marriage and FLR(M) has been granted (note - this could be less than 6 months - but probably no less than 3).

Have I missed something?

I just read your post as though there was a route based on his relationship that he could take and would allow him to work.

Of course - if the lady in question is actually Polish - then he can look at the EEA family member route.

There is a chance that he may be granted Discretionary leave to enter on the basis of his partner being pregnant.A very small chance as it is outside the immigration rules.
Hence the comment ''read the rules for settlement as see if your circumstances allow to apply''

However inside immigration rules I concur with your 4 routes and this should be the way to go if he wants a quick solution to his predicament.
