Hello all, and Mind helping a young guy here please.

Post by caliboyphillip » Sat May 08, 2010 2:12 am

I'm 17 at the moment, I'm from the U.S.A, I turn 18 in August the 8th, oh yeah and my name is Phillip, I'm new here.

I'll start off by saying around almost one year ago I met the most special girl of my life, I'm sure she is the one, I get that one special feeling, I'm sure maybe one of you forum member's know what i mean :) She is 21, It can come off sounding creepy but to me and her there is nothing much of a difference when it comes to our age. I've been stressing out a lot from reading the U.K boarder site.... sigh.... so I read I must be 21 and she must too for the unmarried option for me to even go to the U.K? I'm really just looking at going to be with her, we talk on skype for like 7 hours a day at times during her days off and mines, we webcam and all that, I'm of course not hoping to go there yet, I want to work here in the U.S.A a bit, save up some money for visa or British citizenship.

I want to ask you experts what should i do? I don't want to keep her waiting till I'm 21 to be with her in person, I was hoping to be with her at least before or shortly after I turned 19 but arg... dumb forced marriage policy law. I know us getting married at 21 isn't the only way for me to be there in the U.K, I didn't really do school here in the U.S.A for many reasons of friend getting killed, family issues that lead me to drop out of high school but perhaps some sort of studying in the U.K can and will allow me to go there? some sort of work visa? help from a lawyer who knows the way around. I'm a very bright guy with technology and other things in life.

I hope this isn't a pathetic thing to post! Thanks and look forward to replies, feel free to contact me via PM or E-mail. God bless you all and excuse me if I posted this in the wrong section, by the way I don't want to rush marriage with her eventually why I'm looking for a workaround, even though she does want to marry me and I do too but at this point being 21 isn't an option lol!

I'll keep it relatively short and sweet ...

If you want to be together I think you have 4 options:

1) Study visa - these are for attending university (college) which in the UK generally happens post 18. It costs a fair amount of money and you'll have to secure a place at the uni - which will be tough if you haven't graduated high school (which is the implication in your post).

2) Work visa - tier 1 or tier 2. Tier 1 requires you qualify on points, which you won't without a uni education. Tier 2 requires a sponsor - can someone offer you a job here?

3) She moves to the states.

4) Wait and hope the rules don't change.

Option 3 might be the easiest. Option 2 is probably going to get tougher in the next couple of years. Option 1 is being squeezed in all directions.

You can't apply for the unmarried partner visa as you need two years of proof that you lived together.

Your situation is tough because you would also need to be 18 to sponsor your girl friend in the US and this is a must for a marriage/fiance visa (there is no unmarried partner visa in the US).

The student visa path seems quite hard too since you would first need to be unconditionally accepted to a college or university before applying. All of the universities I applied to required proof of high school graduation before unconditionally accepting me.

I think the best option is to visit each other for a bit and at least wait until you turn 18. Maybe during the wait, you can get a GED or something? I would probably even wait until you turn 18 for your girl friend to visit you actually because the US immigration officers are a-holes when it comes to one person being under 18 while the other is over 18 in a partnership. They have used this reason to refuse a friend of mine sometime back.

Hey thank you for taking the time to reply to me. I see the options that I have at this point. I've been asking as well in another forum, according to what i was told, if she comes to the U.S when I'm 19 years old, we get married and make sure to save some pictures of that as well, then a few days after getting married she can go back to the U.K and then we wait till I'm 21 and like you said hope the rules don't change so I can try to apply for a spousal visa?

I do indeed plan on visiting her for a bit not yet and about me turning 18 for her to come her to marry me, we plan on doing this around the time I turn 19. I won't do a unmarried visa then ha! if she marries me when I'm 19 and she goes back to the U.K a few days after, what process should i go from there.

You have to file a petition for her to join you in the US I-130. Google that and it'll have tons of instructions and steps (you gotta love bureaucracy). Keep in mind this takes about 6-9 months on average.

You can do that - but why?

You'll be separated for 2 years and only able to see each other on visits.

Why the rush to marry?

It seems the OP may have changed his mind now and decided to apply for his gf to live in the states.

Sorry I just assumed you did since you asked how to file a petition for her in the US.

Anyways good luck! Let us know how it goes.
