ILR - 18 months outside the UK

Post by dundee2010 » Mon May 10, 2010 10:26 am

Hello,

I will soon be applying for indefinite leave to remain based on 10 year long residence. Counting the time that I have spent abroad (from the stamps of my passport) I seem to have spend 19 months outside the UK. 4 months, however, were when I was younger than 18. Does anyone know of cases where a waiver has been of the time when the applicant was a minor?

Any help would be much appreciated.

If the 10 year period includes time spent as a minor and is being included to fulfil residential requirements for ILR under the long residence category, why do you think there is (or should be) be a waiver on absence(s) during that time?

Such an arrangement would favor people under 28 but amount to bias against people aged 28 or more applying under the same category.

regards
