Hello,

after reading up on many of the posts here and they have been very helpful. I just want to make sure my wife'd ILR application is in order.

I am a British Citizen.

We have been here two years on a spouse settlement visa (No recourse to public funds)

Jointly we claimed Child & Working Tax credit.

My wife was pregnant and claimed the Health in pregnancy grant which she recieved. I called to check it was ok on her visa and they called her to check her situation.

Jointly we applied for the Sure start maternity grant which we recieved. This was based on my WTC, we had to put both names down.

At one point I did claim a small amount of housing benefit only in my name. This has now stopped.

I claim Child benefit in my name.

I now earn 22k a year.

So my questions.

1. On the form regarding public funds it asks if you are "claiming" in the present tense. Does this mean I don't mention the housing benefit, HIPG and Sure start, as they were claimed and have been awarded?

2. On Child Tax Credit, WTC which were claimed as a couple (as the rules dictate) should I tick both boxes?

£. Does anyone have any advice. I have We have an appointment next Friday and we have 2 small kids that we will need to bring along. Will this help or hinder?

I too have asked in the last week clarification on the same issue with regards to disclosing working tax credit, child benefit and child tax credits.

The stickies are a couple of years old now and I know the law has changed marginally. I believe you do not need to tick that you receive these benefits from reading the stickies, however clarification as we are now in 2010 may just reassure people that they are not filling the Set M form in incorrectly and the possible consequences that may arise from doing so.

I have read all the posts with stickies in the title if this is what you mean but have found little clarification on the whole. An personal experience info would be appreciated.

In this thread above John suggests that the poster ticks yes to claiming Public funds though it would not mean you are breaking any rules with regards to claiming public funds. Regardless I guess they still do their checks as they should, as long you are not receiving any additional funds other than you would get without your spouse living with you, all will be well.
I would tick yes to yourself claiming these benefits as you do not want to get on the wrong side of the caseworker. I think there is need for clarification on this as the threads above do contradict each other.

Edit: Also would your spouse then need to tick yes to claiming public funds for Working Tax credits on the set (m) you do so as a joint claim.

Just to let you all know how it turned out.
We applied and I did not tick the boxes for HIPG or the Sure start social fund payment.
I took the "being recieved" question to mean right now so I only ticked the Child benefit and child tax credit boxes.

It all went fine.
They took our document and money and approved the visa.

Strangely the premium same day service isn't what it sells itself as. In cardiff they send the visa away and it takes 5 days to get the entry before it is returned.
