Switching from student to HSMP-help needed

Post by visionx » Tue Nov 08, 2005 4:38 pm

Hi all

I finished my MSc in Feb-2005 here in UK. But my graduation ceremony was in July 2005 so I had the visa till Nov 2005. Now I want to apply for HSMP for the 2nd time (1st got rejected), but my visa is expiring by the end of Nov 2005. Most likely if I apply now I won't get reply before end of November. So if I apply for any other course and get an extension on my student visa before Nov 2005, then

Que: Will I still be able to switch from student visa to HSMP once I receive the approval?

I mean, should I be able to switch to HSMP visa by applying from within uk. The reason I want to get an extension instead of waiting for approval, is that I am currently doing some job. So if I don't get an extension by the end of November, then I will have to leave the job, which I am reluctant to do.

Anyone having any idea about this situation? Your help will be appreciated.

Thanks

Please have a look at the switching rules at the HO website. It clearly states which categories are allowed to switch to HSMP.
Switching into the Highly Skilled Migrant category
Nationals from non-EEA countries may apply to switch into the Highly Skilled Migrant category without leaving the UK provided they have existing leave as:

Work permit holder; or
Student who has successfully obtained a degree level qualification at a UK higher or further educational establishment; or
Postgraduate doctor or a postgraduate dentist or trainee general practitioner; or
Working holidaymaker; or
Science and Engineering Graduate Scheme participant; or
Innovator; or
Applicant is undertaking the PLAB test, a clinical attachment or dental observer post, who holds a valid Home Office document confirming that he meets the criteria under the HSMP priority application process for general practitioners; or
Fresh Talent: Working in Scotland scheme participant.
