Tier 1 visa adminreview. pls help..urgent

Post by svijayrathinam » Sat Jun 26, 2010 6:51 pm

Hi all,

I applied for a Tier 1 general two weeks ago in chennai india. My application was refused and i have been given an administrative review. The reason for refusal is "unable to consider maintenance funds. father's bank account details submitted does not comply with the published guidelines. hence maintenance funds not considered."

When i applied, i submitted my fathers fixed deposit receipt which had Rs 230,000 (equivalent to 3400 pounds) for more than two years as proof for maintenance funds. I also enclosed a letter from my father saying the money is solely for my personal use and i can use it at any time, signed by my father. In spite of this I have been refused entry clearance and been given an admin review.

Now in my admin review, I have stated the following

" i live in a joint family and my father maintains all the savings. Hence my maintenance funds are in his account. Though it is on his account i do have full access to the money through my father. And he has stated that clearly in a letter which i submitted with my application. If required my father has now offered to add my name as a joint account holder or change the account entirely on my name. He is also ready to give the above in writing if required. I can also produce the new fixed deposit receipt with my name included on it from the bank if required. I have already submitted proof from the bank to say that this money is available to my father at anytime and the same money has been there in his account for more than two years. All the above can also be verified by calling up my father and his phone number is ******.So i request you to kindly grant me the visa."

Do you think this should be sufficient enough to convince the entry clearance manager? They have awarded points on every other criteria and i meet every criteria. I have a masters degree, UK experience, past earnings and all requirements. I even have a job offer. Can anyone help me on this pls? Has anyone ever got a tier1 visa by submitting their parents savings as their maintenance funds? Pls reply.

Thank you,
Vijay.

There are clear guidelines that the maintenance fund should be in an account maintained by the applicant in the policy guidance. I would suggest you start maintaining the fund needed and reapply asap. There might be a cap on the number of visas issued and more strict rules in the coming days.
