Employer not sponsoring anymore. How can I remain?

Post by tiredoftier2 » Thu Sep 02, 2010 10:32 pm

After working on post-study work visa for 2 years I had a visa sponsor from the same employer for a year. Overall I worked 3 years and now they say they will not sponsor me anymore. My visa will expire in 45 days. I would very much like to remain in the country as a employee and I would like to ask what are my options. I can not apply for Tier 1 because my salary was not or more than 25,000 pounds a year. Please help....

Sad situation.
Why ur sponsor is not sponsoring u further, You can easily extend ur visa if they provide u with COS. Make sure they are not in impression that they have to go through Labour market test, etc explain to them that you are eligible and score all points without any effort. If they are not sponsoring u becouse they dont want to pay £170 for ur COS, offer them that u can pay instead.
But if they are not sponsoring u because they don't want u or there is any kind of politics going on....then there is no chance.

If u were on fixed contract type of job, u should have thought about extension from the day one of ur job, it seems u didn't plan for future, no u see the results. Anyway Good luck.

Thank you for your reply.

They said the Audition Department decided that there is no reason to extend my visa.

I was supposed to get a promotion this June but I have not. It's my line manager who decided to promote someone over me who got only 6 months experience and who is trained by me and yet very incompetent staff. I tried to fight the situation but I could not do anything to appeal against the decision and the manager decided me to stay and develop which brings me to the final consequence.

My performances have been amazing, however I didn't get the promotion and that is the reason, I think, that the AD doesn't see a reason to extend my visa...

there is one way u can remain in the country by switching into tier 4. In the mean time u will be looking for another sponsor. once u have a sponsor, u can switch back into tier 2 or tier 1. If u are really desperate, it is worth talking to a immigration law solicitor.
