UKBA announced in July that the requirement to have a Certificate of Approval before getting married will be abolished late this year or early next year.
They haven't announced a date yet, or what, if anything, will replace it. Given the severe disapproval of the scheme right from the start by the Courts, it's difficult to see what they could bring in to replace it. They do say that the requirement to give notice of intention to get married in a designated register office will remain. If the Registrars are under a duty to pass details of all applicants to UKBA, anybody who is illegally in the country could put themselves at risk of arrest by giving notice.
One would assume that it will be easier to get married in the UK, but that doesn't mean that applications for Leave to Remain as a spouse (or civil partner) are more likely to be granted.

hello thanks for reply
my sistuation is that i am a uk national , wishing to marry somone who came on a spouse visa in 2007 and is now divorced with no children. before his visa expired he did not get his ILR from his ex wife so he then applied for FLR extention for some studies, perhaps to switch status.. and to remain a bit longer in the u.k at the moment he has not heard from his extension application wich he applied for in may 2009. his passport is still with the home office so we mite not b able to apply for c.o.a i am thinking we can just have a muslim marriage and move in together, then we can atleast say we are a genuine couple , and maybe a few months can pass and we mite hear from home office or even try to apply for c.o.a but the c.o.a mite get abolished anwyay so we dont realy know wot to do, the only thing i am worried about is if he can stay in uk and not have to go back and apply , i am not so worried about how long it wil all take , as long as we can be together and move in together, also if the c.o.a does get abolished some people say it will be good for us ?
