Settlement Application FLRM and benefit

Post by Taha » Sat Sep 18, 2010 7:40 pm

Hi,

I need clarification from gurus.

I have applied for settlement visa for my wife (FLRM), i have indefinite leave to remain in UK, in the application we have declared that neither she nor me are claiming benefits. Current status of her application is to provide Biometrics. AFTER submitting my wife's application i applied for the child benefit and got approval of benefit today. Please advice what to do in this situation. A quick response would be appreciated. Cheers

You have ILR and therefore you are entitled to claim whatever benefits your circumstances dictate you are entitled to. So claiming Child Benefit is not a problem at all.

But what about Tax Credits? Claimed? If not, why not? Your family income nicely over £50000 per year?

If that does not apply, a claim for Tax Credits needs to be made, and jointly by you and your wife.

Thanks John,

I have requested for Child Tax credit forms which i am eligible for but have not applied yet!

I was only concern that in section 7 clause 7.6 of FLRM we have ticked No i.e. Are you or your partner receiving any public funds? which was true at the time of submission of application. However i have now got the approval of child benefit. Shall i highlight this to UKBA?

There is no need to tell UKBA about any benefit claims.

This subject is fully dealt with in the Claiming Benefits section of this Board, to which I am now going to move this topic.
