Does Criminal record mean NO VISA?

Post by parafira » Wed Sep 29, 2010 12:57 pm

Hi,

Could you please help me in one matter?

Currently I am on Tier 1 General visa.
I will have to extend it in 2 years.

There is a possibility that I may have a Criminal Record for a minor offence (not having valid London Underground Ticket).

Will I be able to extend my Tier 1 General visa, or criminal record will mean NO VISA?

Thanks,

Have you been convicted of the offence in court and a fine imposed? If so, when were you convicted?

Or did you just pay a penalty fare?

I have not yet been convicted. I did not pay a penalty fare, Revenue officer just took my details.

But there is a possibility that I will be summoned to a court and may be convicted.

If I will be convicted, can I still extend my visa? I understand that I will have to disclose a criminal record in my visa application.

Let's assume I was convicted and have a criminal record. Will I get an extention or not?

Criminal record or conviction per se doesn't necessarily lead to refusal of application. What is important is that one declares the information in the form truthfully.

No one can tell you whether your extension will be approved (or refused) based on assumptions and without knowing the details of conviction.

Thanks sushdmehta

Now it is clear. So there is a chance of getting an extension.

Details: Although I had a valid ticket between two stations, I was taking a not permitted route. Revenue Officer checked my ticket and said that he is taking me to a court. Court will hear my case and may decide that I was deliberately avoiding to pay, and may convict me.

That is very strange as well as silly on part of London Underground. There must be some rules regarding travelling without ticket for LU. For national rail, one must get ticket onboard if he/she could not get ticket in advance. Once I travelled this way and bought ticket after reaching destination by contacting station staff and explaining situation. If ticket examiner approached you and discovered that you had wrong ticket then I don't know what to expect. But I guess taking some one to court for this kind of offence is shear waste of court time.

I agree, having a criminal record because of a wrong ticket is ridiculous.
I believe they sew a few people just so that other would be scared.
