Am I Eligible for ILR

I Entered U.K under Work Permit category in Sep 2008 valid till Sep 2010,
I applied for Tier1 in mar 2009 which was refused due to maintenance funds , My employer granted me Visa in Sep 2010 under Tier2 category valid from Sep 2010, However under the Pankina judgment my Tier 1 application was considered and I was granted Tier1 Visa till Nov 2013(for 3 years).
My question is Will I be elegible to apply for ILR in Sep 2013, As I was on Tier2 Visa for 2 months .

if the rules stay the same (which in my opinion is highly unlikely) then yes u should get it after 5 years. i.e. 2013
