New Entry Clearance in between 4 yr period for ILR

Post by kirtipri » Tue Feb 07, 2006 11:49 pm

Hi,

I have been in the UK on WP from Jun 2000 till date however I was out of country for 12 months in 2002 and while I was out of UK, my UK WP expired and when my company again brought me into the UK, they had to apply for a new WP so I had to get a new entry clearance to the UK from British embassy in Mumbai.

I was out of UK for business purposes (I am an IT consultant). My employer has given me in writing the purpose of my abroad stay with dates.

The HO asks for 4 continuous years for ILR. Though I have completed 4.5 years excluding my 1 year gap, my UK WP was not continuous.

Can anyone please advise whether this will create any problems in my ILR application. I am going to apply in next few days. Thanks in advance for the advice.

Regards,

Dear,

Would request for your valuable comments/suggesstions/experiences.
Is there a harm in I applying for ILR ? Would they stamp a rejection on my passport if the ILR is rejected ? Please advise.

Thanks,
Kirtipri

if you have worked for the same employer and no breaks in the WP then you have chances of approval, provided that you have all the documentation to prove it..

if there is a gap in the wp of more than a year, like in the case of the OP, then the chances are very slim
