Non-EEA Family Permit Rights

Hi , Be Gentle my first post

My wife who is Thai is joining me in Northern Ireland on an EEA Family Permit. I have dual Irish/British citizenship. My wife has two children ( from previous marriage) aged 14 and 17 and we will be applying for them to join us hopefully in the new year.

I have read through many of the posts but am still unclear on rights etc:

Here are a view questions:

1. Can I/We claim Child Tax Credits ?
2. Can I/We claim Tax Credits?
3. Can my wife register with the NHS or do I need to get personal insurance?

Given you mention an EEA Family Permit, it is relevant to ask, in what way are you exercising Treaty Rights? Employed? Self-employed? A student? Or what?

And the children? Where are they now, in Thailand? Does your wife currently have Sole Responsibility for them?

When does the 17yo become 18 years old?

In answer to your questions,

1. I am in full time employment.
2. The children are currently in Thailand.
3. My wife has sole responsibility.
4. 17 year old becomes 18 on the 11.12.2010.

OK, no problem with those benefit claims .... once the children are in the UK.

Have the applications already been made for the EEA Family Permits for the children? IF not make the applications as soon as possible. After all they are not obliged to travel the instant they have got their EEA Family Permits.

Use of NHS, by your wife and her children? No problem.

Sole responsibility? Re-reading your previous post, your wife is still in Thailand with her children? Or is she already in the UK, and someone else is looking after the children?

We are in the process of applying for passports for the children,once received we will then apply for EEA Family permits. My wife is currently in Thailand with the children and will be with me before Christmas , the children will be staying with their grandparents .

We want the children to finish their current school term (ending in April 2011) before bringing them over.

While my wife is in the UK we will be looking at employment options,schooling etc in advance of the children coming over,to make the transition as smooth as possible.
