dilemma asylum seeker

Post by provman22 » Sat Dec 18, 2010 8:35 pm

Hello

Please I need help please, I dont mind any response, u can be as hush as possible I just to know where I stand.

I was arrested in 2009 by the police for a minor offence and cautioned but I gave the police a false name and dob. At the time I was illegal due to the refusal of visa application as a dependant. My family back home where all killed after this and I now fear going back to my country. I have since claimed asylum but I am losing my mind because the people at asylum unit have not spoken to me about this offence and I dont knoe what will happen to me since I perverted the court of justice. I am constantly waiting for the police to knock on my door or to be detained. Will I be charged and imprisoned and then later deported. I am really scared. Should I tell them what I did and hand myself in to the police. I am so scared, the offence was a mistake that I regret everyday and I am now a christian.

What do I do, I know I desrve everything I get but am torn inside by this.

Thanx

It would help if you gave more specific details.
What country is back home?
Do the Home Office know where you live?

As mochyn said, we need more details before we can advise you.

To add a few things:

1. What was your offence?
2. Did they take your fingerprints when they arrested you for the minor offence?
3. (As said previously) Where are you originally from?
4. How long have you lived in Britain?
5. Have you any British or EU family living in Britain?

I would always suggest being honest, as things can always come back and bite you on the bum but we would need to know more details before we can help you.

The offence was shoplifiting (£30) in money, given a caution and my fingerprints were taken yes. The home office do know where I live. I am from Iraq and I have been here since 2009 but things got really bad in my country (as we all know) and I could not go back readily due to my family been threatened.

A caution for shoplifting will not affect your immigration case. However, if you gave a false name you are liable to be prosecuted for perverting the course of justice, which is a much more serious offence. That could get you a prison sentence of more than a year, which would cause UKBA to seek a Deportation Order against you.
If you have made an asylum claim, that has to be decided before any other action is considered, and you have a right of appeal if it's refused. If you commit any more crimes and the police or UKBA realise you are using two identities, you will go to court and probably to prison. So if you claim to be a Christian, act like one and stay out of trouble.
