Spouse ILR

Hi,

I know this has been discussed several times but I couldnt find an answer relevant to my question.

I am eligible for ILR in Jan 2011.
My husband is on an independant Tier 1 visa but is not eligible for ILR until June 2011, although he has been in the country since June 2006( on his own WP and now Tier1).

My question is if I were to get my ILR in Jan and he were to apply for a spouse visa of a settled person thereafter, when can he apply for his ILR.

Does he have to wait for 2yrs as he has not been my dependant at any stage , or he can apply immediately as he has been in the UK for 2 yrs.

If he switches to FLR(M) after you are granted ILR, then he will have to wait another two years before being eligible for SET(M).
