psw to Work permit dependent

Hi there,

I am a work permit holder from 2009 - 2013. My husband is currently on Tier-1 post study work, which is due to expire in Jan 2012 and hence we are planning to change the visa category to workpermit dependent.

He is currently working in UK. Does anyone know if a person has to leave his job if he has to apply for the visa from the home country?

Also, I will be grateful if anyone can point us to something where we can find more details on guidance notes, which form to use, and what supporting documents are needed for the application.

Thanks for any help you can provide.

ukba website is your first port of call....

if your hubby can get "holidays" from work until he gets dependent visa... then its ok.. otherwise he would need to quit the job

Thanks folks.

I did call up immigration bureau to ask if my husband can apply from UK only and they said no. However, when we took advise from few of the visa consultants here, they said yes, he can.

Does anyone have experiance for this?

Also, I was wondering how is visa application different from entry clearance? Do we need to apply for entry clearance separately if he is applying from India (home country).

If you are a Tier 2 migrant, then he cannot apply from within the UK (i.e.- cannot switch) as 319C(h) is not satisfied. If you are WP migrant, then he cannot apply from within the UK (i.e.- cannot switch) as 196A(v) is not satisfied.

A visa application from outside the UK is an application for entry clearance.

some so-called visa consultants are known to lie to applicants to secure their own "fees". Do your research first and foremost, and see how they respond in light of the paras mentioned above by moderator!
