Can I file an appeal against Tier 1 dependent

Post by Manno1 » Wed Jan 12, 2011 4:09 pm

Dear All,

My visa has been recently refused on the basis of short funds available for Tier 1 dependent visa. Its a misunderstanding on the part of BHO therefore I am going to file for an appeal. I understand appeal cases normally takes longer therefore I was thinking if I could apply for a visit visa and file an appeal at the same time. If I get visit visa on time then I would be able to travel to UK earlier.

Your kind advice will be highly appreciated! Thank you

If the refusal is due to an error of judgement at the ECO's end and can be overturned at the local level (BHC), it may be quicker to get the decision overturned if you submit the appeal in the country of application.

Having read your previous post(s), it is not yet clear if an appeal will result in you being granted entry clearance and whether appealing the decision is the right course of action in your case.

Thank you for your help. Well I shall try the way of appeal. Yes we have been together for 2 years. Can I submit the tenancy agreement of both of my and my fiance's name as a proof that we have been together for 2 years?
