ILR for spouse and child

Hi,

By the end of this month I am going to complete my 5 year stay in uk ( work permit + tier 2 (current status is tier2 visa) and planning to apply for ILR. My wife came to UK on dec 2009 and her stay is now 13 month long. Also I have two month old chid born in UK and currently hold no visa at all. My question is, Can I mention her and child as my dependents in my ILR application.

I have read a lot about this on net and really confused now what to do. I am seeking some help from you. My final take on the current situation is

As her stay is less than 2 years so I cannot mention her and child in my ILR application. Instead first of all I need to get the ILR for myself and after this I have to apply for the visa of my wife and child using FLR (M) form. Once the visa is granted then we have to wait for another 2 yeas (current stay of 13 month will not be considerd in 2 year qualifying period) before we apply for ILR for her and child

Could some one confirm that I understood correct and this is the only way to proceed.

You are correct. you can not include your dependents along with you currently.

You may include your UK-born-child in your settlement application. Alternatively, apply for settlement for self and when granted settlement, register your UK-born-child as a British citizen under section 1(3) using MN1 form.

to clarify any child who was born in UK and whose parents now have settled here becomes british citizen? i thought it only applies to children who are born when either parent already have settled status.

If the child is born in the UK before either parent has been granted settlement, then following either parent's being granted settlement, UK-born child is eligible to be registered as British citizen under section 1(3).

If the child is born in UK when either parent already has settled status, the child is automatically British. So, there is no need for registration.
