ILR - 180 DAYS ABSENCE CALCULATIONS

Hi Sushdmehta,

There have been many queries regarding the calculation for 180 days absence for ILR. I was searching through ILR pages to find more about it. Under this thread, I found your quote as:

Can you please advise if your post regarding the calculation of absences is based on UKBA immigration rule guidelines or is the calculation at the caseworker's discretion?

Coming from the moderator, I will like to believe your statement and it will keep all concerned knowing clearly what is required :)

Technically it is correct as you were still within UK on that day (even if you left at 1 minute past midnight) however as far as i know, there are no official guidelines.

there have been many cases where people have got ILR with more than 180 days outside (including myself with 220 odd days). it all depends on your justification for absence. if it is work related and you were paid in this country it is unlikely you will be declined based on this rule alone.
